my son has not attended school and im really upset. i tried to get help from the bd.of ed. in nyc but they keep giving me the run around. his dr. said he needed to go to this special school because he dosent want him to climb stairs,carry text books or take gym ...ok so the 1st day of school i was at the bd.of ed working with the district health coordernator to get him into school .....well since then i havent had any luck with the pupil transportation , the school ,or the bd.of ed. so now im really upset because my son now hates school! he has always been a straight a student ,never had a problem with another student or a teacher he used to love school but now he says he cant wait till hes 16 so he can sign his self out! this is what his life is becoming becauseof this diesease and i am really upset! and to top it off none of the nyc public schools have that difibulator machine ....even the special schools that have heart patients! well i had to let that off my chest and now i think im going to have to be forced to home school him because i really have no choice now he wont pass to the 7th grade next year anyway because of the absences anyway ....i just think its a shame that he went from a straight a student who loved school ...to a kid who hates school now and has to be home schooled just because we have to try harder to get him to the next grade.

I have heard of rights that some students with disabilities have to the development of IEP's, i.e. Individualized Educational Plans, developed for some students with disabilities.
The context in which I heard of these rights is children with cerebral palsy. Many of my clients and their parents have had to pursue legal remedies to have school districts develop individualized plans for their education.
While I am confident that some on this board will have more specific advice, I feel the need to share the limited information that I have.
I would suggest that you contact some of the advocates for children with disabilities in your state. In my state, the leading advocates on this issue are the staff of United Cerebral Palsy. You may also want to contact attorneys who work in this area, either through a local program funded through Legal Services, or a law school clinic.
Sometimes those who advertise themselves as practicing "education law" will be the most helpful.

Hi,
I'm a little concerned because it is very rare for a kid to go from being fine to being unable to carry his books around. Is your son really this incapacitated or is the doctor over-reacting? If you aren't sure, please get your son to an HCM specialist asap and see if he can't get back into normal school.
You can also investigate defibrillators and getting them placed in his future school. However, if your son is really at risk for sudden death, then he just needs an ICD (implanted defibrillator).
It is just plain wrong that this is so difficult. You really need to get in touch with the authorities and rattle their cages. Lisa may be able to give you an idea of what to say and to whom.

You should not have these problems with the school, this is simply a mess. We will assist you as best we can in getting him back to school!

Each state should have a protection and advocacy agency that represents children with disabilities.

You can always try calling the state bar associations, local legal services agencies, local law school clinical law programs, or librarians to obtain further names of agencies or information.
One of my rules for solving problems follows:

I am not unique. Therefore, if I have a problem, someone else has likely faced, and solved, a similar problem in the past. If I can find that person, I do not have to reinvent the wheel. I can take advantage and benefit from all of her work.
So I ask myself: Who would have faced a similar problem in the past?
Find that person, and I have saved myself a lot of time, money and trouble.
Usually, if I am looking for some interesting general information, some government agency has it. Often congresspeople and city council members are able to help me.
If all else fails, ask a librarian, or a law librarian.
